1. Who we are

This online store at milanocupertino.com (the "Store") is operated by PACF Digital Ltd. Co. (doing business as “Milano Cupertino”), a limited liability company organized under the laws of the State of New Mexico, United States, with its registered address at 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States ("Milano Cupertino", "we", "us").

2. Scope and your statutory rights

These Terms of Service ("Terms") apply to all orders placed through the Store by consumers in the countries we ship to. By placing an order, you accept these Terms as in force at the time of your order.

Nothing in these Terms limits or excludes any mandatory rights you have under the consumer protection laws of your country of residence. Where any provision of these Terms conflicts with such mandatory rights, your statutory rights prevail, and the conflicting provision applies only to the maximum extent permitted by the law of your country.

The following documents form an integral part of these Terms: our Shipping Policy, our Return & Refund Policy (including the instructions on the statutory right of withdrawal and the model withdrawal form), our Warranty & Authenticity terms, and our Privacy Policy.

3. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to place an order. By ordering, you confirm that the information you provide is accurate and complete and that you are purchasing as a consumer for personal use, not for resale.

4. Products and product information

All Milano Cupertino jewelry is crafted in solid 925 sterling silver; we do not sell silver-plated base metals described as silver. Where a piece is described with a gold or black finish, that is an authentic precious-metal finish — a layer of real 18k white gold or black rhodium applied over the solid 925 silver, not solid gold — identified as such on the product page and subject to the finish conditions described on our Warranty & Authenticity page. Our dedicated 18k gold line, where offered, is made in solid 18k gold and identified as such.

Product weights, dimensions and stone counts stated on product pages are accurate within normal manufacturing tolerances. Because each piece is individually finished by hand, minor variations in surface finish and stone placement may occur; these are characteristics of handcrafted jewelry, not defects. Product photography is as faithful as possible, but colors may render differently across screens.

All products are offered subject to availability. Where a piece is made to order, the product page says so, together with its production time.

5. Prices, taxes and import duties (Delivered Duty Paid)

All prices are shown in the currency of your market and are final: they include all applicable import duties, customs fees and, where applicable, VAT or sales-related taxes for your destination country. We ship on a Delivered Duty Paid (DDP) basis — you will never be asked to pay anything additional to receive your order, as detailed in our Shipping Policy.

Prices may change at any time, but changes never affect orders already placed. In the event of an obvious pricing error — one that a reasonable customer would recognize as a mistake — we may cancel the affected order before dispatch and will refund any amount paid in full, immediately.

6. Ordering and contract formation

Your order constitutes an offer to purchase. After you place an order you will receive an order confirmation email; this confirms receipt of your order but does not constitute acceptance. The contract of sale is concluded when we dispatch your order and send you the shipping confirmation. If we cannot accept an order — for example due to stock unavailability, a pricing error, a failed fraud or verification check, or delivery restrictions — we will notify you promptly and refund any amount paid in full.

You may cancel your order free of charge at any time before dispatch by emailing contatto@milanocupertino.com. After dispatch, the return rules in our Return & Refund Policy apply.

7. Payment

Payment is due at checkout and is processed through Shopify Payments and the payment methods displayed at checkout for your country. Your payment details are processed by our payment providers under their own security standards and are not stored by us. To protect all customers, orders may be subject to verification and anti-fraud checks; we may decline or cancel an order that fails them, with a full refund of any amount paid.

8. Promotions and discount codes

Discount codes and promotions are subject to the specific conditions communicated with them (eligible products, minimum values, validity period). Unless expressly stated otherwise: one discount code per order; codes cannot be applied retroactively to orders already placed, exchanged for cash, or combined with other codes. We may withdraw or void codes that are published, generated or used in a manner not authorized by us.

9. Shipping and delivery

Shipping terms, carriers, destinations, delivery estimates, customs handling and what happens if a delivery fails are set out in our Shipping Policy. Every shipment is insured by us until delivery; risk in the goods passes to you upon delivery.

10. Right of withdrawal and returns

If you are a consumer in the European Union or the United Kingdom, you have a statutory right to withdraw from your purchase within 14 days of delivery without giving any reason. We additionally extend a voluntary 14-day return policy to customers in all other countries we ship to. 11. Legal guarantee of conformity and the Milano Cupertino Lifetime Warranty

As a consumer, you benefit from the legal guarantee of conformity under the laws of your country of residence: in the European Union (including Germany), a minimum of 2 years from delivery; in the United Kingdom, the remedies of the Consumer Rights Act 2015; and in the United States, applicable federal and state law warranties.

In addition, solid 925 sterling silver pieces are covered by the Milano Cupertino Lifetime Warranty against manufacturing defects, described in full — including its conditions and exclusions — on our Warranty & Authenticity page. The Lifetime Warranty is a voluntary commercial guarantee provided in addition to, and never limiting or replacing, your statutory rights, which remain fully unaffected and free of charge.

12. Personalized items

Items that are engraved or otherwise made to your personal specification are excluded from the right of withdrawal and from voluntary returns, as permitted by applicable law. This never affects your rights in respect of defective items.

13. Intellectual property

All content on the Store — including designs, product names, photography, videos, text and branding — is the property of Milano Cupertino or its licensors and is protected by intellectual property law. It may not be reproduced, distributed or used commercially without our prior written consent. “Milano Cupertino” and associated marks are trademarks of PACF Digital Ltd. Co. and its affiliated companies.

14. Reviews and customer content

By submitting a review, photo or other content to the Store, you grant us a non-exclusive, royalty-free license to display it in connection with the Store and our marketing, and you confirm the content is yours, truthful and lawful. We may decline or remove content that is offensive, unlawful, or unrelated to a genuine purchase experience; we do not edit the substance of genuine reviews.

15. Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law — including your statutory consumer rights and remedies.

Subject to the foregoing, we are liable without limitation for damage caused intentionally or by gross negligence. For damage caused by ordinary negligence, our liability is limited to the breach of essential contractual obligations — obligations whose fulfilment makes the proper performance of the contract possible in the first place — and to the foreseeable damage typical for contracts of this kind.

16. Force majeure

Neither party is liable for delay or failure to perform caused by events beyond its reasonable control — including natural disasters, strikes, carrier or customs disruptions, war, or acts of authorities. We will inform you of any such event affecting your order and of your options, including cancellation with a full refund where delivery becomes impossible or unreasonably delayed.

17. Consumer dispute resolution

We are not obliged, and do not undertake, to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact us first at contatto@milanocupertino.com — we make every effort to resolve any issue directly, quickly and fairly. This does not affect your right to bring proceedings before the competent courts described in section 18.

18. Governing law and jurisdiction

These Terms are governed by the laws of the State of New Mexico, United States, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the European Union, the United Kingdom or elsewhere, this choice of law does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, and you retain the right to bring proceedings before the courts of your place of residence where applicable law so provides.

19. Changes, severability and language

We may update these Terms from time to time; the version in force at the time of your order applies to that order, and the current version is always available on this page. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force, and the invalid provision is replaced by the valid rule that comes closest to its purpose. These Terms are concluded in English.
